Being NAMED in an indictment doesn't implicitly mean someone was implicated in a crime you buffoon since being implicated indicates that one was intricately involved in the perpetration of the crime.
As anyone who actually read the docs would know, Nicky wasn't involved in the criminal acts of the perpetrator and as such he was never indicted.
