Motion Hearing 4-15 10am.
I left the hearing around noon. I am hearing on other chats that BDFR was there as well. He sat in front row behind prosecutors for those that dont believe me. He was wearing shorts and left early. I did not have a pencil to take notes, and I am not MGK but here’s the cliff note version.
1) The files are going to be sealed, only because of the email addresses that they contain, and those persons receiving negative emails from investors. They will be un sealed once the email addresses are redacted. Moving forward all email addresses will be taken off documents prior to becoming public. All new emails will not contain email addresses, but it was acknowledged that these email addresses will become public at the trial.
2) Kazam was present, Nader was not.
3) The trial may be delayed because of findings in the new FDA communications with so much negativity towards Cytodyn. The defense has identified three more persons that they need to see their emails. As they had a negative opinion of Cytodyn prior to the BLA being filed.
4) Kazems Defense stated that they did file an incomplete BLA, but should’ve been given a chance to send in the missing data points. I guess this is not uncommon. They were expecting to have the FDA come back with some guidance and allow them to submit the missing data points in a couple days after submitting. But his defense states that FDA was not going to give it a chance.
6) Early arguments from Govt that some of Kaz and Naders “expert witnesses may not be experts. Judge seemed to disagree.
7) The judge did rule against the prosecution and they must get with FDA to get the three person emails in a certain time frame. The prosecution said they will try to have the emails to the defense team by Thursday, both parties will talk to the judge on Monday to see if the trial needs to be delayed.
