Again, ignoring the fact that the breach of contract continued under NSF's watch, which NSF was made aware of and did not stop. The lawsuit didn't come until after. NSF was complicit in withholding the data at that point which was in breach of contract. They would no longer be covered by the indemnification clause that you enjoy speaking so often about.
