The Supreme Court refused to hear an appeal of the criminal conviction of Florida nursing home owner Philip Esformes.
Esformes, who had his 20-year prison sentence commuted by then-President Donald Trump in 2020, is on track to be retried on six health-care fraud criminal counts that his original jury deadlocked on.
Prosecutors have said he led a massive Medicare fraud, and used the proceeds to buy a Ferrari, a $360,000 wristwatch, and the company of female escorts.
His attorneys argue that Trump’s clemency bars Esformes from being retried.
