The very visible elephant in the room is the FDA sanctioning Amarex/NSF...for whatever they saw as wrongdoing...AND has been noted already...hard to get a stronger endorsement...Maybe someone up there really does love us.
A pivotal point for us... was the announcement that the FDA wasn't pleased with our former CRO...and was acting on it...IF I was a arbitrator...that fact alone would weigh heavily on my decision criteria.
Punitive damages have to be part of the overall calculation...I mean We have cookie jar fingerprints...All over this.
