i see, It does seem that for arbitrations, the dates for the steps in the process are decided at each stage, so i could see this extending outward. However the date for the decision by the arbitrator has been set - august 2024, so maybe both sides need to get there discovery and hearings squeezed into that timeline or the arbitrator will decide on that date no matter?

Either way, i think this will get settled sooner. as much as Amarex, NSF and their insurer might want to extend this, they also don't want a potentially massive ruling against them. I would think there ability to raise capital and there growth plans are very impacted with this hanging over them. Cytodyn may be at all time low SP, but it has not disappeared yet despite everything that has gone against them.

imagine if Leronlimab was only an MDR HIV drug with no other indications. if the BLA got so trashed as it has, Cytodyn would not just be giving up on the HIV MDR approval, they would be done as a company. If cytodyn gets a partner or some funding in anything, Amarex and NSF will know that cytodyn is not disappearing and they will eventually have to pay for this. their lawyer (if they have not already) is going to convince them to settle this asap when it is a cheap as possible. Cytodyn just needs to show the ammunition they are going to present to the arbitrator and make sure it is iron clad.
