Disclosure: I am here for the Patents plural and intellectual property rights related to Eli 216 and 154 and the real money garnered in relation to them. Still 2-4 years away IMO but quickly becoming much more of a reality as opposed to my first purchased shares in 2011. It has been more than a painful ride. In my further opinion, there has been no better time than these past few months to purchase shares in relation to what the company is doing related to their pipeline. Elite has the technology to more than challenge Purdue and Pfizer in the Abuse Resistant Opioid space.
There used to be 6 Abuse Resistant Products on the market.....NOW there are only 5 as Pfizer has been unable to rectify Embedas stability issues.
1) Suboxone
2) Oxycontin
3) Opana
4) Oxecta
5) Exalgo
6) Embeda (Whoops)
Now out of those 5 Abuse Resistant Opioids on the market...........Actavis has rights to the generic version of every single one of those above products EXCEPT Embeda.....and if you know anything about the history between Pfizer and Actavis related to Embeda....you realize the only place Actavis is going to get the rights to its own version of Embeda is for Elite to build Actavis a better Embeda.....which it is doing IMO via Mik001. The other possibility I see is a Hydromorphone/Naltrexone product....but I hope for Elite's sake Mik001 is a Better Embeda and not a Hydro /Nal product. My conclusion related to the latter will become clear below.
Once you begin to understand the magnitude of a company like Actavis needing to come to Elite to get in on a product that it cannot make itself you begin to get even an inkling of the Abuse Resistant technology (ART) that Elite owns itself outright. And note that Actavis came to Elite for Embeda before Elite garnered the patents on the very technology that Elite is using to make that better Embeda.
Now it is true that Elite had best keep moving forward on their Abuse Resistant Drugs! Should the FDA and/or Congress mandate new opioid formulations to carry abuse deterrent properties the already competitive Abuse REsistant space will do nothing but heat up and heat up quickly for that matter IMO. Still, Elite will be sitting pretty in one of only a few catbird seats regarding many generic companies needing to license abuse deterrent technology as they won't have the time or money to create their own technologies and yet these companies will still wish to compete in the multi billion dollar abuse deterrent opioid space. They will only have so many choices in regards to licensing this abuse deterrent technology from pharmaceutical companies that already own their own abuse deterrent technology such as Elite owns.
Then you take what JT has already publicly mentioned regarding his personal goal......to put out a whole line of Abuse Resistant Opioids with their patented technology. One possibility would be to put out a Branded Abuse Resistant product such as Embeda but say with Hydromorphone/Naltrexone. As far as I can tell there isn't a product of this combination on the market currently.
How would a company like Actavis then obtain the generic rights to this Branded Hydromorphone/Naltrexone product as the company plans to own the generic rights to as many abuse resistant opioids as it can obviously ???
If the FDA moves in the fashion it looks like it will be heading.....Actavis would only be able to submit little of Elite's data as the reference listed drug to Actavis's Hydro/Nal Anda submission.....bc Elite will have used Patented technology for this NDA drug. Even if Elite wanted to let Actavis use their reference listed drug data.....the FDA wouldn't let Actavis as Actavis would need to license Elite's technology or come up with their own Abuse Deterrent technology and then see what the FDA would say about doing so?? What the FDA would do in the latter scenario is yet unknown but has significant positive financial bearing on Elite no matter how the FDA decides down the road on the matter IMO.
I realize Elite has the capability of making their Eli 216 product itself....within that Billion Dollar space......that is a Game Changer in and of itself for Elite.....but when you consider Elite's Intellectual Property rights potential for their patented Abuse REsistant technology (ART) and the possibilities become absolutely staggering! This staggering possibility is when you begin to realize that shares bought now have the real potential to set one up for a really nice retirement.
