I do agree with you, even though your speculations are optimistic. I wonder why cancer was not mentioned in this or the previous CC? Why would Antonio mention we are in mending fences mode with the fda, as if he was explaining why there is no optimistic explanation for the FDAs requests. Nader would have been spouting out how we are about to get full approval and piss off the FDA, this mgmt team might be accepting of the FDA needing testimonials, protocols etc and keeping quiet about the why out of respect of the fda, I think there were many questions sent to Cytodyn requesting answers to why the fda was asking for so much especially when these seem to have little to do with safety data.
There is no question that NSF is part of the arbitration, the insurance held by Amarex and nsf must be north of $100 mil. I think when the arbitrator sets a date, there will be a very aggressive effort to get a settlement. This could happen soon. There insurance company does not want to be on the hook for hundreds of millions if they can end this with 100 million. If a guilty party is known to be guilty and makes no effort to settle, the arbitrator may feel compelled to consider massive punishment. SA I’m sure can build a damages dollar amount for far more than $100mil.
I’m not going to bring up a share but back, it won’t happen even though it is somewhat fair to investors. Most would want the money spent to get real partnerships based on great data from many indications.
Do we think there is a chance that Cytodyn publicly ending the hiv bla was partly to give the fda the freedom to be part of forming an hiv approval that fits the data they see? I doubt it. It is clear to me that nothing gets approved unless big pharma is involved, the fda will not stick it’d neck out for a little guy. The fda wants Cytodyn to partner so they are helping build the path for Cytodyn to do so.
