We’d all like to know what is going on. The company needs to tell us something. But, none of us knows what the current situation is.
There is no reason for the arbitration to be delayed until the hold is lifted. Amarex’s failure to perform the tasks in a way that the FDA was satisfied with is provable with data that CYDY currently has — which is to say, the FDA’s explicit statement that Amarex did not present the data at the 2nd submission in a way which followed the FDA’s guidance, and the opinions of the independent auditors that the data is not usable.
What difference does having the hold lifted make in terms of CYDY’s case against Amarex? Nothing.
