The arbitrator is not above the law in any way whatsoever. Most likely, the arbitrator was chosen by the two parties based on their familiarity with arbitrations of this kind of subject matter. They are also certified to do this job, not some random guy off the street.
The arbitrator's decision is not beholden to the clinical holds being lifted as I see it, because the FDA did not have any data from the Amarex trials from which to draw conclusions, thus the holds are based on something entirely different in nature than whether or not Amarex was guilty, negligent, at fault, or any other kind of words one wants to use here.
