The NSF CEO told Nader, in emails so there is documentation, that he would personally look into Nader's allegations about Amarex misconduct. Then CYDY did not get responses for a year.
This should be at least a good basis for argument that NSF did control Amarex, and thus the corporate veil can be pierced -- because they were not hands-off keep-your-distance, but in fact took over running Amarex WITH THEIR OWN EMPLOYEES.
If Sidley-Austin can prove that Amarex's actions were beyond mere incompetence, it is possible that they can get this into court. Alleged criminal behavior is a whole different ball game than failure to perform at a professional level. S-A has very smart attorneys, so if anyone can figure out a way to break the arbitration agreement and get it into court, they can. A conspiracy to harm CYDY could potentially allow them to ask the feds to investigate via RICO.
Let's not forget that Nader and the former Amarex CEO are involved in litigation for alleged insider trading AND conspiracy to do it.
