For a lawsuit, you generally pay by the hour and if the case takes 2 years, you could easily be talking millions of dollars paid if you're paying over $1000/hour for a top law firm. Just one month, full time, at $1000/hour would be $160,000!
For an arbitration, the law firm may agree to a percentage (generally no more than 33 1/3%) of whatever the award (not called damages) is which is the law firm taking the gamble on a big win that will cover their time and then some.
