My sense is that the pending start of the NoPain Act due to start in 2025 (and yet a big push going on now to get it going by 2024) is creating more than a sense of a glimmer of hope for some. I think it’s become a general sense of urgency for prospective buyers/partners.
It is a sea change given the political thrust and spotlight resulting in the passage of this Bill, and much more so given the requirement that CMS place non-opioid treatments monetarily ON PAR with other separately paid drugs. Good as gold.
The leopard cannot change its spots, nor the tiger its stripes. Any such idiosyncratic and intractable traits, true or not, yet seemingly perceived by the prospective buyer about the other party, best be left at the door before getting to the negotiation table.
The focus should be on the “process” by the prospective buyer(s).
That process just took a big turn with the NOPain ACT. Any tactic other than process that personalizes negotiations will leak across that table, and one gets bitten, or worse.
It indeed takes two to tango. But sometimes, one dance partner will step on your feet, for whatever reason. Smile, and then move on with the show. If one wants that partner bad enough.
