simple, Amarex's signature is on the filing to the FDA, Amarex can choose to not file the BLA due to not wanting to loose their license as a CRO. No matter what any CEO says. Amarex did not do this, they filed crap work and Nader can not make them do it. Keep in mind, this is over 2 years after the actual trial was done, I think it is safe to say there were many emails about the status of payment, what amount of the work was completed and when the BLA would be filed. not just that one email with Nader telling them to file it.
Nader may have told them to file it even if it is not done, but when Amarex did file it (weeks later) Amarex may have said its done, we filed it. We don't know because we only know what Nader said and not what Kaz told him.
