Well, that's not actually how it works under the law. The law doesn't sit back and wait possibly YEARS to see if a drug works or not if someone in a position of responsibility like a CEO makes millions while others drown based on statements that, by law, a CEO should not make.
It'd be akin to saying "Well, the doctor left a sponge in the patient and they got an infection, but hey, they survived just fine, so no malpractice."
The DOJ knows what they're doing and wouldn't bring an indictment where they need to "step easy on the allegations." When you're indicted like this, it's pretty heavy.
