There is arbitration with Amarex right now, not litigation.
You cannot like CYDY's chances unless and until you know what Amarex's side of the story is regarding the BLA. NP seems to have been told by Amarex that the BLA wasn't ready, but he made them submit it. That is NOT fraud by Amarex, it's just submitting an incomplete document. Not illegal.
Patients check OUT of a hospital against their doctor's advice all the time. That's not illegal for a doctor to allow to happen. And keep in mind that the US is NOT suing Amarex or CYDY, they are suing their former leaders personally.
