Equitable relief has to do with asking a court for something such as an injunction, which cannot be granted by an arbitrator. It's basically asking for the other party to do or to not do something versus asking for monetary damages. Only a court can award equitable relief like that.
It can be very hard, time consuming, and expensive to prove gross negligence and/or willful misconduct.
As for the "built to sell" comment, again, this was long talked about a few months ago and was not my idea alone. They brought in dealmakers, not clinicians.
