This language seems to be Sidley Austin's claim before a court rather than to the arbiter. "It is undisputed that the parties’ respective damages claims will be resolved through arbitration, but this Court is the proper venue for CytoDyn’s equitable claims pending arbitration."
I wish I knew what equitable claims were here. It was my understanding that a tort claim asked for money as a remedy, but an equitable claim stemmed from damage money can't repair. And an equitable remedy would not in fact be money, but perhaps making Amarex watch NP videos over and over and over until they begged for mercy and revealed how they'd colluded with Gilead to defraud CYDY. Yes, that's probably it.
