However, as it relates to "settlement", doesn't arbitration bind and negate the need for court in that the arbitrator decides the outcome based on the submission of all parties? ("binding arbitration"
as opposed to mediated settlement negotiations (by a specified mediator)... if the latter results in zero successful negotiations/ settlement, an actual court action (motion, trial) follows?
