This, in combination with people submitting complaints to the SEC are the only real avenues shareholders have to be made whole, or at least get some level of satisfaction.
No doubt about it - he has issued materially false and/or misleading statements, failed in his responsibilities in terms of disclosures and required timing of disclosures, repeatedly issued positive statements about the company's business, operations, and prospects that were materially misleading and/or lacked a reasonable basis. Share issuances are also suspect.
Plenty of law groups out there who specialize in pretty much this alone.
