Also, what is at issue is whether CYDY has to pay Amarex more money for work which was, according to the FDA, performed at an indisputably substandard level.
Although it would be greatly to Amarex's advantage to have all other possible outstanding claims (by CYDY against Amarex) also settled along with the payment issue, CYDY can sue Amarex for FRAUD, which is what a reasonable person might infer from the evidence of utter incompetence at best or deliberate sabotage at worst, from Amarex's completely inadequate execution of contracted tasks.
