If you signed an NDA, and there was no non-public information disclosed, hypothetically, does it violate anything to say there was no new info? How long would I have to wait to say, hypothetically, that they tried to sell those 200m shares in an old-fashioned dog-and-pony show, shiny butterfly Paulson can't-tell-you-anything-solid way while the share price was falling like a knife? Maybe they got new investors to come in, like you might with a brand new startup.
Now they want to go again with 350m? Pay attention to the shadow puppets and smoke/mirrors, ya hear, or we'll cease operations. I'm recalling ERabbit's remarks about 'no concern for share price'.
It's interesting to watch possible no voters get attacked with a Size (share count) Matters challenge. In the weeks/months before the Vyera deal, I'd check the .30-.49 closing share price and the volume traded and think, man, I own more shares than the paltry volume traded for the whole session. I type that knowing my yes or no vote won't make a difference in the final tally.
