1) Law cited was a targeting law to a specific business. plus it was passed post "intent to approve.and should have had no bearing on the West Warwick project.(grandfathered)

2) The Ri-DEM should not have denied over the issues in the first half of denial. The proper procedure would have been to go back to SNPW and give SNPW an opportunity to address their revised concerns.
Important to note, SNPW provided every thing that RI-DEM requested of them hence the issuing of a letter to "intend to approve"
