SCHEDULING ORDER: A Bench Trial is set for 6/1/2022 at 09:00 AM before Judge Robert T Dawson in the Western District of Arkansas at the Judge Isaac C. Parker Federal Building in Fort Smith, Arkansas. Pestell Civil Case Bench Trial begins on June 1st at 9am.
Courter vs Cytodyn class action case update:
The judge granted an order for the plaintiffs. They now need to resubmit a petition to request access to documents that Cytodyn will be submitting to the SEC / DOJ. They have to submit the amended complaint by June 24, 2022.
The original deadline for Cytodyn to file a motion to dismiss the plaintiffs complaint was May 26, 2022. It has now been pushed back to August 23, 2022.
Based on timelines below, this case looks to be ongoing well into 2023.
ORDER Granting100 Stipulated MOTION: The currently existing deadlines regarding Defendants'95 Motion to Dismiss are vacated. Deadline to file the Amended Complaint: June 24, 2022. Deadline to file any Motion to Dismiss: August 23, 2022. Deadline to file a Brief in Opposition to any Motion to Dismiss: October 7, 2022.
