KKR: Judge Koeltl view of what is public information seems to be a bit extreme. If a regulatory agency intervenes to start an investigation, once the company is made aware, so should the shareholders.
Disclosure of that information would not compromise the investigation in any way yet would be a transparent way for the owners of a company (the shareholders) to be kept aware of what is going on.
