The $6.5 million is not for the arbitration. Judges don't interfere in arbitration hearings by forcing a bond upon a company for them. The matter before the court was the transfer of the data and the audit. The bond is for any cost to Amarex for the data transfer and audit.
From what Amarex has said the cost to them would consist of buying an additional log-in to the system for Cytodyn. I am sure there will be a few other incidental expenses. How much does a ream of copy paper cost? What Cytodyn pays should be nowhere near $6.5 million unless Amarex is grossly overcharging.
180 days for Cytodyn to cover a guaranty. Do you think a data transfer and audit will take over 180 days? Do you think Cytodyn will be unable to pay the small sum owed to Amarex?
What are the odds that Cytodyn defaults on the agreement and Welch gets the patents. With such miserly sums involved I would guess zero. In order for a default Cytodyn would have to not be able to pay the small amount owed to Amarex then further not pay back Welch that minor amount of money if he has to kick in the cash.
