If there is a material event, they have to report

They haven't reported a material event so there hasn't been one before last Tuesday. There could have been something this past week but they haven't hit the reporting deadline yet.
Negotiating is NOT a material event and they don't have to say anything unless they reach an agreement, and then they have the 4 days. If there is some kind of agreement, they would most likely need to agree on wording with whoever the negotiating party is so it might take the full 4 days to work that out.
The most obvious thing that they would be negotiating is some kind of settlement with Amarex. Given that BOTH sides have agreed to kick the deadlines down the road -- that's my guess. Nader may have wanted to say "hey, here we are on a conference call telling you that we are negotiating with Amarex and it's looking fantastic" and Sidley Austin unplugged the microphone and said "Nuh-uh."
