I have to ask, I just don’t understand what Amarex is thinking. If they were unable to do what they were paid to do, why did they lock Cytodyn out of there data? I get that they were basically using the data as blackmail for getting paid, but it is obvious they were not finishing the work. Why would they let this get to arbitration? They must think they are in the right somehow? I don’t understand why Cytodyn needs to put up the cash bond at all, it’s their data and the contact is clear about it.
I can only assume Amarex is trying to negotiate a way that they can hand over the data and not be potentially sued for damages. It might be they know they are in trouble and are just being difficult because that is all they can do. Right now time is the most damaging thing to Cytodyn, any delays in the BLA timeline is what will hurt us. Lawsuits for damages will take years, we need the BLA filed now.
The other question is what amount of work is needed to finish the last part of the BLA? Is it possible it is all done and a few tables just need to be populated with the data? Weren’t they able to extract the data already from the trial sites and we just Ned too show it is backed by the official database? Or, nothing can get done until they get the data?
