Are you guessing that’s what happened because it doesn’t say that. They are off the hook but maybe that’s because they don’t have enough yet to prove they are also at fault. It doesn’t say they extended the deadline in exchange to release NSF off.
This also doesn’t mean NSF can’t be liable if we find evidence otherwise, but it sounds like we are going to settle soon.
“The NSF dismissal is proper as the events took place prior to the purchase of Amarex by NSF. Even then the dismissal is WITHOUT prejudice meaning other claims may be brought depending on what is found in the future.”
