I've skimmed to page 171 now. How can this thing move ahead when many of their allegations are dependent on the outcome of CYDY v. Amarex, and the outcome of the clinical trials? The plaintiffs are mad that the clinical trials haven't yet met endpoints. Uh..... they're not done yet.......
I hope that CYDY doesn't spend a lot of expensive Sidley Austin time on this -- just enough to get this thing deferred until the allegations the plaintiffs are making can be discredited or supported by facts, which will not be available until these other matters are settled.
And I still wonder -- why did they gratuitously throw in a paragraph about Martin Shkreli? Was that boilerplate from some other lawsuit and thrown in by mistake?
