Having had to threaten to bankrupt a sub once when I was a corporate treasurer...
Imagine that the judge's ruling is Amarex has to pay CYDY $50m. Of course Amarex has nowhere near that cash.
What happens if NSF doesn't help out? Amarex goes into bankruptcy. And NSF has to write down an asset it recently paid good bucks for to zero. Their owners won't be happy about their acquisition due diligence. If it gets sold, CYDY is in line for proceeds before NSF.
That's why NSF's business decision is likely to be to help out even if the "corporate veil" isn't "pierced."
Unless of course NSF's current due diligence concurs Amarex should be shut down because this is the tip of the iceberg.
