"According to Sidley amended answer about the timeline:
Cytodyn made several attempts over the course of the last year to rectify issues with Amarex including work being invoiced but not performed.
Some time prior to June 2021, they began asking for access to the EDC because in early June, they went above Amarex to Mr. Lush of NSF complaining that after multiple requests they were still being ignored.
On June 8th, 2021, Mr. Lush responded by email that he didn't understand why Amarex was denying access to the EDC as it was the property of Cytodyn and contractually stated that Cytodyn has access to it at all times.
Mr. Lush asked Cytodyn to withhold contact with Amarex as he would see to the dispute being resolved.
Mr. Lush and therefore NSF became point of contact from that point on.
By August however there had been nothing resolved at which point an audit was requested.
Amarex denied the audit circa August 2nd, citing concerns over Covid-19 contact within their facility by an independent auditor.
The independent auditor assured Amarex he could perform the audit remotely without needing access to Amarex facilities upon which circa August 3rd, Amarex cited non-payment as cause to deny the Audit.
Cytodyn and Sidley then proceeded to prepare and submit the current court case."
