Also: the FDA gave a letter to Cytodyn showing Amarex failed to file annual IND annual reports.
Also: from Sidley court documents sent in 3 days ago, page 13, point 39:

Backdating is of course a pretty serious offense.
I think there's more I've forgotten. If you read the posts of @Aaron on the YMB board, he's very good -- comprehensive, but also fair.
The short version is that I don't see how Amarex, and even NSF, can get away without extensive damages. IMO, more than we've paid them already, which is $60 million. Think about how the last year would have been different if they'd correctly filed the HIV BLA -- no toxic loans, NASDAQ listing, institutional investment, off-label use. It's not a small difference.
