What if you're not doing your job and the only leverage the company has is to withhold any FURTHER payment until the work that was ALREADY CONTRACTED FOR is completed to professional standards?
That appears to be the case here. I say this on the basis of parts of the Refuse To File letter that someone has emailed me. The FDA was scathing in its statements about how Amarex had data but did not attach it to the document, how there were missing dates for at least 15 patients involved in the trial, and more things. I'm sure that eventually someone will post the entire RTF letter here.
So anyone defending Amarex now -- please wait until you've had a chance to see the things that some of us already have seen. Amarex's conduct can't possibly be considered to have been at a professional level nor worthy of the payment that they already received, much less the complete 80 million that would be due UPON COMPLETION of the tasks.
