CYDY held off with distributing the proxies until after the Delaware Court decision. They then announced they were going out within the next day, but later announced it would be the following week. I noticed they didn't distribute them until the day after the 13D's last gasp (injunction request failed). In my opinion, this is why they had so little time to get the required votes necessary for the quorum.
