I was told by a reliable source that an appeal was in the works, but when I asked on what grounds they would appeal, the person had no idea. As an attorney (and logical thinker) it makes sense to me that when a judge says "You didn't follow the rules that were in black and white, you lose" then there really isn't much to appeal there overall.
