The company can't put out the ballot until they know whether the 13(-x)D gang is going to be on it. If the Delaware court decides that the people who failed to disclose their many conflicts of interest, and didn't meet the deadlines for true disclosures, should nevertheless be allowed to continue their effort to take over CYDY, then a ballot with their [expletive deleted] names on it will go out.
If the Delaware judge follows the law and denies their attempt to be on the ballot, then a different one will be sent out, that does NOT have the names of their take-over gang on it.
