13D is very foolish if they think that shareholders will NOT sue them if they were somehow to manage a board take-over and then pull some stunt like stopping clinical trials, or buying IncellDX, or other things that are not in the interests of the shareholders.
And unlike most shareholder suits, which are so often bogus and a blatant attempt by a law firm to get a company to pay a relatively nominal settlement in return for the bogus suit being pulled --
if 13D tries to pull dirty tricks, I guarantee they will find themselves in court double-quick.
[Note: companies often pay off law firms to drop even obviously unsupportable and absurd lawsuits, because it's cheaper to pay them a couple hundred thousand than it is to hire lawyers.]
