Wow, interesting week!
While I thought that Brazil was priced in, I tend to lean towards Evil, that the Brazil news and the Philippines update might be driving the latest surge. I also think that NP has gone to an earlier page in the playbook, which is the Emerging Growth circuit. We need new investors, and this is a good source. I think it has helped.
The filings tonight from 13d are interesting. The most recent one seems to say that 13d is no longer a thing. It has been effectively dissolved and now it is just the rock group of Rosenberg, Wilmes and Beatty. Not quite CCR, but it is all that survives.
And, just prior to that, we had a filing that seems to say that the debate is largely over. RWB (not RTB), have filed several new disclosures about connections to incellDX, patent lawsuits and the involvement of Pestell and Tony C.
It APPEARS that the CYDY team is going to accept these additional disclosures and therefore allow the vote to take place on new directors (including the RWB slate).
I'm basing this on this quote: On September 16, 2021, the Participants and the Company jointly informed the court that they have agreed on supplemental disclosures that are contained herein, and subject to the filing of these supplemental disclosures, the parties will file a stipulation of dismissal on Monday, September 20, 2021.
If I am misinterpreting the impact or import of the above quote, I'm looking to MarcS and the other great lawyer that has been posting here to give new direction.
I personally love this line from tonight's filing: If the Participants succeed in electing their director nominees to the Board, the Participants intend to name Dr. Patterson as the Chief Medical Officer of the Company (either as a direct employee or as a consultant).
I love it because it:
1. Is clear
2. They aren't going to ask Dr. Patterson to be CEO
I "less love" it because I would prefer that none of the board members are also employees. But, I'm willing to make an exception because it is Dr. P and I am a fan (Evil....chime in here...).
But, again, this seems to confirm that RWB are NOT planning to make Dr P the CEO. Many have surmised that this is a fact/done deal. Well they were wrong, based on what is in writing.
Lastly, and you will love this.....I think the stock moved because of Brazil news. But, I also think it moved because news of the "détente" leaked. Anyway, welcome back to $2! That damn Ken Chowder bought about 30,000 of my shares at $1.35 Good for you Ken!
