I think that was just the motion to dismiss filed

I think that was just the motion to dismiss filed by the 13d in the current court case not a new case. The motion to dismiss is based on a lack od claim and lack of jurisdiction. It's a Delaware corporation in a Delaware Chancery court, it looks like an act of desperation.
