They’re bashing the company in a filing, they’re now referring to as its TICKER: CYDY, instead of CytoDyn.
Is this code for someone or entity? Is it to CYA?

I’ve seen “a group” suddenly talk positive in one post to make it seem like they offered another positive perspective on boards when in fact they haven’t for months or ever.
There also seems to be a slow change of emphasis put on the fact that there’s a difference in investing behind “Leronlimab” and investing in “CytoDyn” .
I don’t believe a proxy is even possible anymore. Their relationship with CytoDyn share holders for current management are unsalvageable. (And likely for the undecided).
THERE IS NO DISPUTE THAT DISCOVERY WILL BE NEEDED IN THIS CASE.
I believe they’re purposely stalling to hinder Sidley’s APPROPRIATE response. (And as we seen today, maybe to potentially damage the SP for obvious and maybe not obvious reasons).
The email, (regardless of whether it was from Paul or anyone else) shows that they didn’t file in time, but they showed enough to demonstrate that everything was already in place for the proxy.
It seems like Sidley believes there’s still more uncovered.
Remember when a group insinuated on message boards by amending the filing that it “proves no entity is behind it” Sidley seems to think otherwise, as I personally do and CytoDyn needs discovery to prove it. Its pretty clear a group is avoiding it.
Amendments are made to correct things by accident. You don’t file your taxes PURPOSELY lying just to have the ability to “amend” it after you get caught, do you? (Rhetorical Q).
CytoDyn is saying just let us know if any defendant, entity, IncellDx, or anyone funding this proxy will profit off of taking over the board.
That’s not asking much FOR share holders, is it?
Plus other communications that involved this proxy at any point in time.
(Which I believe to be fair since they seem to have been caught in a lie and/or withholding info that’s pertinent to SH’s decision making ability).
They basically undercut Sidleys time to respond by holding a meeting until today, and are hoping the judge dismisses discovery and allow proxy to continue. Fortunately for us, the company obtained documents that don’t require discovery, since the email pre-dates to the ALREADY organized, but NOT SEC filed proxy. This seems to undo all possible good faith they had with the court.. they pretty much said “Hey judge, please believe us” (but this recent discovery from an email puts them in bad faith). This sounds similarly like they’re asking SHs “please believe our plan is good.”

Seems like many trials; plus this sec document states Sidley is in fact, correct and Sidley is telling the court we just want discovery to prove we are correct AND close to discovering the “true facts.”

If there’s nothing to hide, they should let shareholders get ADDITIONAL discovery to prove CytoDyn right (or wrong) that the Proxy is in fact, Valid for TRUE Democracy.
