I know you already know this, but there is someone on Yahoo that claims this response is to the motion to dismiss. It's not.
The opposition to the motion to dismiss is due tomorrow, this was the reply to CYDY's motion to expedite.
However, the briefing on the motion to expedite is now complete, so the judge will either take oral argument or set for oral argument or take under submission (I don't know their rules there or what the briefing/scheduling order stated).
The ruling on this motion to expedite might be a precursor to the motion to dismiss because we will learn a lot about the judge's thoughts here.
