The big criticism of Nader is a lack of industry experience and a rough on the edges communication style. If a candidate was proposed with a real plan to get to the next level, great. I don't see much of anything to suggest Rosenbaum is any better suited than Nader. Patterson may be an asset, however he likely would not have any interest unless the whole board and management team was replaced.
My guess is that this 5% have a plan that has been in the making for some time. The 13d filing was a "no turning back" moment for this group. They made the call that enough was enough in there minds. I do think the compensation committee vote to enrich the BOD and mgmt. team was part of a defense against this group years ago, the lawsuit was a response to it knowing that unless they removed the shares given to the BOD and mgmt., they would not be able to get to 5% as easily. This 13d being filed so soon after the lawsuit settlement is not a coincidence.
What is the 5% plan? I remember Nader mentioning a low-ball offer years ago that he had to fight against. It could be Tony was working on a deal which would explain the silence at that time. I feel the plan is that they want to take control and sell the company ASAP. I don't think they have any idea how to run the company or what they would do differently etc..
don't get me wrong, If Nader really has hit a wall and just can't get this across the finish line for whatever reason, then partnering/selling might be the best option. It could be the gap between what Nader thinks cytodyn is worth and what is being offered is maybe that Nader has a crazy high number in his head that really scared away all opportunities. Could be the opportunities found this 5% group to be there best option to get ownership of the drug. This could really blow up in the 5% face also. The BP that might be watching this could really be using this to smother cytodyn.
As much as the next few months will be a rollercoaster of trial results and possible purchase orders, there will also be a big effort to derail and distract. As if getting a drug approved was not enough.
