You must have forgot to include the rest of the post, where the author asserts (and continues to do so) that he disagrees with my other statement that the SEC Settlement is inconclusive on the subject of whether or not fraud was committed. He seems to htink that fraud was most certainly committed.
"The SEC Setttlement is similar. It does not say that fraud occurred."
I think you need to read it again.....maybe a little slower.
For example:
" IX.IT IS HEREBY FURTHER ORDERED, ADJUDGED AND DECREED that pursuant toSection 20(e) of the Securities Act [15 U.S.C. § 77(e)] and Section 21(d)(2) of the Exchange Act[15 U.S.C. § 78u(d)(2)] , Defendant is prohibited from acting as an officer or director of anyissuer that has a class of securities registered under Section 12 of the Exchange Act [15 U.S.C. §778l] or that is required to file reports pursuant to Section 15(d) of the Exchange Act [15 U.S.C. §78o(d)]."
