You can file an FOIA with the FDA. Though doing so seems a waste of effort at this time. NP made it clear many times during the Dr. Been interview and CC that per the FDA, CD12 data did not meet EUA criteria. Filing an EUA, with what we know now, would be a waste of time and money (money is tight right now).
Today’s PR says we’ll get an update on the US EUA process during the CC, although I personally don’t believe “conditional EUA” is an official FDA title. Maybe we get an update on CD16 as well?
