You're assuming that CYDY didn't know there were only 62 critical patients in the trial when they submitted the data (i.e. they didn't look at it first and blindly submitted it). I disagree, and I think they were smart enough to submit the additional protocol with the data. It clearly states below that the additional protocol was filed "concurrently" to allow them to quickly enroll patients "during the pendency of these ongoing regulatory discussions".
The PR clearly states "Given the size of this critically ill population relative to the trial’s size (62 out of 384 patients), the Company has concurrently filed an additional protocol with the FDA using the existing sites from its CD12 trial to quickly enroll patients in this population during the pendency of these ongoing regulatory discussions."
That doesn't sound like they submitted the additional protocol after they shared the data and started their discussions.
We all know your disdain for NP, but you continue to underestimate him and he's much more savvy than you think. Weren't you recently predicting that we wouldn't see the results for several more weeks, yet we got them earlier than he predicted (2-3 weeks)?
