A mysterious company whose name can't be mentioned doing mysterious things in the background with a governmental agency. Where your assertion falls apart is that mixing a blinded study with an unblinded OLE means that the p value is suspect in the view of the FDA. The OWS does not decide the fate of a drug the FDA does.
