If he doesn't have a working kit then he went to a heck of a lot of trouble to manufacture and package bogus kits that were sent out to shareholders. Who knows how many kits were produced! The kits and the packaging looked really good from what I could tell. These kits were manufactured and packaged in Korea, so that means his people in Korea were in on it too.
Did he just tell his guys in Korea to manufacture and package these kits even though they don't work? His emails and phone were monitored, right? I'm just trying to imagine how these conversation went with his engineers in Korea and why none of this was mentioned in the indictment (with regards to the saliva kit).
Let's face it, if the FDA CLIA certified lab testing was all a lie, it's over. On the other hand, I just don't see how you can lie about something like that in a company press release. That would just be plain stupid.
If he did lie about all this, he not only hurt himself, but he deceived all the loyal shareholders that trusted him and supported him for years. If he has a working kit, then it could really help his case. If he doesn't have a working kit, then it's not looking good.
