It is always

The states constitutional right to offer mail in ballots. They were granted that right under the Elections Clause of the Constitution.

However it not a lets do it process like we seen in 2020. There are constitutional requirement in each state that must be met. This was side stepped.

The EC vote which actually elects the President certification was given away in many states to the SOS. This violates the equal protection clause of the US constitution. Michigan, Wisconsin, Illinois and Pennsylvania come to mind. 90% of the states in these cases represent the Republican...yet 10% of the land area controls the politics. So by giving the control of the EC certification to that 10% and 1 SOS you have silenced the voice of many. If the legislature had control of the EC vote then it should be a representation of those that hold power in the state legislature. The democratic republic process has thus be circumvented to a Democratic democracy which we are not.

So there are several process in the present, that is Unconstitutional. Foremost surrendering the EC vote certification. In the US Constitution, only the legislative body has the right to certify. If these Rino's are not Representative of the will of their majority voting block in their districts. Then they are not serving the will of "We the People" They are serving themselves. Which is unconstitutional and a violation of their oath of office and violates the equal protections clause of the US constitution.

The EC by legislature takes it down to the grass roots. Winner takes all mentality of politicians isn't Constitutional. They are require to vote for the majority of the consensus of the people they represent.
