"Normally, contracts for federal funding toward the development of a drug or vaccine include Bayh-Dole rights, allowing the government to "march in" and take over a drug or vaccine if the manufacturer that received federal funding can't or won't make its product on reasonable terms.
Feldman and others say that this could include setting an unreasonably high price. The pharmaceutical industry often says it disagrees with that interpretation of the law, but the way companies have negotiated their Operation Warp Speed contracts suggests otherwise.
Some of the companies working with Operation Warp Speed have altered the march-in rights in their federal contracts, narrowing the window for when the government can intervene."
